11.3 Waiver. A waiver of any right or remedy under the Contract is only effective if given in writing and shall not be deemed a waiver of any subsequent breach or default. No failure or delay by a

Party to exercise any right or remedy provided under the Contract or by law shall constitute a waiver of that or any other right or remedy, nor shall it preclude or restrict the further exercise of that or

any other right or remedy. No single or partial exercise of such right or remedy shall preclude or restrict the further exercise of that or any other right or remedy.

11.4 Third party rights. A person who is not a party to the Contract shall not have any rights under or in connection with it except for those rights afforded to the Agent as contemplated by these

Conditions.

11.5 Variation. Except as set out in these Conditions, any variation to the Contract, including the introduction of any additional terms and conditions, shall only be binding when agreed in writing and

signed by Yorkshire Water.

11.6 Governing law and jurisdiction. The Contract, and any dispute or claim arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims), shall

be governed by, and construed in accordance with, English law, and the parties irrevocably submit to the exclusive jurisdiction of the courts of England and Wales.

 

STOCKPILING AND SPREADING GUIDELINES FOR YORGROW (Deployment & SUIA)

PLEASE ENSURE YOU (OR YOUR SPREADING CONTRACTOR) HAS THESE GUIDELINES WITH THEM WHEN THEY ARE SPREADING.

Stockpiles: Stockpiles should not be moved for any reason. If you have any queries regarding the status of a stockpile please contact us on 01964 544 415 immediately. Although we will monitor all stockpiles, it may be that you notice either significant slumping or movement – and if so, we may need to implement rectification measures to ensure its compliance. NO other organic manures can be stockpiled or spread with any YorGrow products. Failure to comply could breach your NVZ regulations.

Spreading: The Biosolids that you are intending to apply should be spread in line with the following guidance, incorporated within 24 hours and comply with any other measures and application rates that are described in the Deployment paperwork or delivery licence. There should be no variation to this, for any reason.

The Code of Good Agricultural Practice (COGAP) for the protection of Water, Soil and Air recommends that you should NOT apply manures when:

-the soil is waterlogged, the soil is frozen hard or covered in snow, the soil is cracked down to the field drains or backfill, the field has been pipe, mole drained or subsoiled, over drains in the last 12 months, -heavy rain is forecast within the next 48 hours, winds are prevalent towards housing that may cause a nuisance to local residents.   You should also not apply organic manures: within 10 meters of any ditch, pond or surface water, within 50 meters of any spring, well, borehole or reservoir that supplies water for human consumption or for farm dairies, -on a steep slope where runoff is a high risk throughout the year, on any areas where you are not allowed to because of specific management agreements or other schemes e.g. ELS strips next to hedges etc, if it is likely to create public nuisance from odour.

NB Fit window protection guards on equipment used for spreading if possible. These can protect the operator as well as reduce the risk of broken windows.

Once land has been spread please maintain any harvest intervals or grazing restrictions that are identified in the Safe Sludge Matrix.
